| You have to get patents for ideas; works of art (drawings, writings, etc) are inherently owned and copyrighted by the creator (they can sell that copyright to someone else, but JKR has not, obviously). |

| Sigh... There's a difference between getting a patent and owning a copyright, you know. If you made a crappy drawing, you would own the copyright to it, then and there. You don't have to "get" a copyright for it; it is yours from the instant you start drawing it. If someone stole your drawing and sold it for millions, you could rightfully sue them because they would have made peanuts from something which they do not own the rights to.
And it doesn't really matter if we get off-topic on these boards. |

| But it's not like we're saying that we created them, nor are we making any money off of it. We all know that they are from Cubetoons, and we all know that JKR made them, so what difference does it make? I just thought that people would miss the old smileys. And besides, I highly doubt that JKR cares that we are using his smileys. |
